Real estate regulatory authority, Gurugram dismisses plea demanding revocation of a RERA registration certificate issued to housing project Araville of Supertech Limited

IEP Chandigarh, September 28

The real estate regulatory authority (RERA), Gurugram, on Tuesday dismissed a plea demanding revocation of a RERA registration certificate issued to housing project Araville of Supertech Limited by the authority early this year.

The RERA bench led by Chairman, Dr. KK Khandelwal and the three members dismissed complainant’s plea after detailed arguments and scrutiny of documents in the full quorum view.

The authority noted that the complainant failed to produce before the bench the requisite documents to substantiate its own plea despite being given adequate opportunities of hearing since May this year.

The authority issued RERA registration certificate to Araville in 2019 and Supertech has moved a fresh application for renewal of the registration challenged by the complainant.

The authority put on record the final arguments on Tuesday that the complainant’s challange that the title of the land on which the project is proposed is unclear and self explanatory, devoid of supporting documents and the authority has no reason to revoke the registration certificate.

“So the complaint stands dismissed,” said the authority.

Dr. KK Khandelwal said, “We gave enough hearing opportunities to complainant to produce facts of land title dispute on which the project is proposed but the complainant failed repeatedly.”

To decide the title of the land does not fall in the RERA purview noted the authority dismissing the plea.

Supertech is developing a premium housing project Araville on land admeasuring ten acres at Sector 79 on Golf Course extension road near Kherki Daula toll.

Supertech is the developer collaborator in the project and Tirupati build plaza private limited is the licencee in the project.

It was alleged by the complainant that Tirupati build plaza private limited did a forged-mutation of 10 acres land in its favour to obtain licence from the TCP department government of Haryana.

“That for the purpose of obtaining the licence Tirupati forged a sale deed wherein the description of land was changed, so authority (RERA) is requested to revoke the registration certificate,” said the complainant’s plea.

The authority also noted that the complainant’s plea was dismissed by the TCP, revenue department and the civil court already and an inquiry into the allegation also did not corroborate the land title dispute claim of complainant.

The first hearing in the matter took place on May 9 this year and subsequently seven hearing followed.

“As many as eight hearings took place in the authority and all efforts of scrutinising papers all end up in dismissal of the plea since it was self explanatory and it was waste of time,” said Khandelwal.

RERA on Tuesday entertained more than 100 complaints.

Haryana Government should release white paper regarding vacant posts and jobs given : Kumari Selja

IEP Chandigarh September 27

Member of the Congress Working Committee and former Union Minister Kumari Selja said that the anti-youth BJP-JJP alliance government was following the policy of ending employment opportunities in the state. Instead of filling the vacant posts, they were being ended. HSSC should be dissolved for not rolling out any recruitment from February 2021 till now. The government should issue a white paper regarding the vacant posts in the state and tell how many jobs had been given and how many posts were lying vacant.

In a statement issued to the media, Kumari Selja said that according to the report of CMIE, Haryana had the highest unemployment rate in the country. Despite this, the state government had directly cut 13462 posts in the new fixation of posts and froze about 25000 posts. Government data showed that there were 4.58 lakh posts of government jobs in the state, which had been reduced to 4.45 lakh, she added.

The former Union Minister said that in 1980s the population of the state was 1.25 crore and there were 4.50 lakh posts of government employees. Now, the population had increased to around 3 crore, so the number of personnel should have been more than 10 lakhs. On the contrary, instead of increasing, the positions were being decreased due to which the work load on the employees was increasing and they were getting mentally disturbed.

Kumari Selja said that how ironic it was that 41 percent posts of personnel in government departments were lying vacant. In the year 2022, the recruitment process of only 6010 posts had so far been completed. HSSC had not rolled out a single recruitment since February 2021, while 182497 posts were lying vacant. She said that most of the posts were lying vacant in departments such as Police, Public Health, Education, Transport, Animal Husbandry, Irrigation, Health and Panchayat which were directly linked with the common people.

Kumari Selja said that 11.36 lakh youth had applied for CET of Group C and D and the state government had not been able to conduct the examination for a long time. Apart from this, the validity of the certificate of HTET pass youth was about to expire and the alliance government had not rolled out any recruitment for them. In such a situation, the validity of their certificate should be extended, added Kumari Selja.
