Haryana Right to Service Commission while taking stringent action against a Kanungo of Badli, Jhajjar has imposed a penalty of Rs. 10, 000 for his dereliction of duty in the delivery of a notified service.Giving more information in this regard, RTS Secretary informed that an appeal was raised through Auto Appeal system in a case where the appellant has applied for a notified service under ‘Demarcation of Land if no standing crop’. Taking cognizance of the matter, the Commission called for an immediate enquiry. A hearing in this regard was conducted on March 7, 2023 through Video Conferencing which was attended by Sh. Sriniwas, Tehsildar, Badli, Sh. Vijay Singh, Kanungo, Badli and Sh. Vijay Pal, the complainant.He informed that during the hearing, Sh. Vijay Singh, Kanungo submitted that demarcation was delayed due to late delivery of the map by the operator of DGPS machine who was a private person hired by the complainant. On the other hand, the complainant, Sh. Vijay Pal submitted that he had followed up with the Kanungo regarding the demarcation report but didn’t receive a positive response even after multiple reminders. Further, the Kanungo never informed him regarding the non-availability of the map from the operator, he tried to misguide him by telling him that his signature on the application were missing. RTS Secretary stated that the Commission has carefully considered all the facts and found that substantial delay has been caused in the matter due to dereliction of duty on the part of Sh. Vijay Singh, Kanungo, Badli for keeping notified service pending for more than 6 months.RTS Secretary added that he not only misguided the complainant by saying that the report was delayed due to absence of his signatures on the application but also made no efforts to obtain the required map from the DGPS operator. If the Kanungo had informed the complainant about the non-submission of the demarcation map by the operator, the complainant would have ensured its availability.The RTS Secretary further informed that the Commission imposes a penalty of Rs. 10,000/- on Sh. Vijay Singh, Kanungo, Badli for his dereliction of duty in the delivery of a notified service and orders that a compensation of Rs 2,000/- be paid by him to the complainant, to compensate for the harassment caused to him in availing a notified service. He added that the commission will continue to take stringent action against officers/officials taking laxity in their approach towards public work.
