Punjab approves reservation for posts of law officers :  Dr. Baljit Kaur

Candidates belonging to SC category can apply for the reserved category posts of Law Officers in Advocate General Branch of the Punjab Government by 13th September 2022. This was stated today by Punjab Minister of Social Justice, Empowerment and Minorities, Dr. Baljit Kaur.

She said that the candidates can apply online by 13 September 2022. They may apply at http://Punjab.gov.in and send their documents at e-mail-ID pblorec@punjab.gov.in.

The cabinet minister said that these posts have been advertised for the first time in Punjab. She said that the state government led by the Bhagwant Mann is committed for the welfare of Scheduled Castes and is constantly striving to give them their rights as per law.

IN YET ANOTHER FIRST, PUNJAB GOVERNMENT INTRODUCES RESERVATION FOR LAW OFFICERS IN STATE

In yet another pioneering move,  the  Punjab government led by Chief Minister Bhagwant Mann has introduced reservation in  posts of law officers recruited by the state government.

The advertisement in this regard was issued by the department of Home Affairs here on Saturday in which applications have been called from eligible Scheduled Caste Advocates/ candidates for engagement as law officers in the office of Advocate General, Punjab at Chandigarh and Legal Cell, New Delhi. . As per details applications have been invited for 12 posts of Additional Advocate General (10 at Chandigarh and two at Delhi), for post five posts of Senior Deputy Advocate General at Chandigarh, for 16 posts of Deputy Advocate General (14 at Chandigarh and two at Delhi), for 23 for posts of Assistant Advocate General (22 at Chandigarh and one at Delhi) and out of two posts of Advocate on Record at Delhi from eligible SC candidates. The eligible candidates can apply for post by September 13, 2022.

Meanwhile, the Chief Minister said that he had always been a votary of giving equal opportunities to the youth of SC community to excel in every field. He asserted that the state government has been implementing the reservation policy in true spirit to ensure that  candidates of weaker and underprivileged sections get equal opportunity for getting jobs. Bhagwant Mann unequivocally said that for the first time in history of the state the Aam Aadmi party government has made this provision to give reservation to SC candidates in recruitment for post of law officers too.

The Chief Minister lamented that despite of enormous capability of SC candidates, they have not got a chance to make it for the posts of law officers due to many  reasons. However, he envisioned that with the state government introducing reservation for these candidates it will enable them to serve judiciously as law officers. Bhagwant Mann asserted that Aam Aadmi government is probably the only government in the country to provide reservation to SC community for these posts.

Reiterating the firm commitment of state government to ensure well being of SC brethren, the Chief Minister said that no stone will be left unturned for this noble cause. He emphasised that the state government is making all out efforts to provide equal opportunities of progress and prosperity for the community. Bhagwant Mann said that unlike the previous governments which had only made lip service for welfare of community, the Aam Aadmi government has taken tangible steps in this regard.

DEMAND for 85% RESERVATION in Regular/ Contractual / Outsource JOBS in Chandigarh Administration & Private Sectors and in Various Educational Institutes of Chandigarh for admission

Today, the Ward No. 12 Councillor, Advocate Saurabh Joshi wrote an OPEN LETTER to the Hon’ble Governor Sh. Banwarilal Purohit Ji demanding 85% RESERVATION POLICY, for those holding a domicile of Chandigarh, in Regular / Contractual / Outsource JOBS in Chandigarh Administration, Municipal Corporation, in private sectors etc. And in various Professional Colleges, Punjab University and its affiliated colleges of Chandigarh for admission.

He accented that Chandigarh, a U. T, even though being a joint capital of the two states i.e. Punjab and Haryana is deprived of any reservation policy in these two states. Whereas, both these state have made reservations policies for the people with domicile of these very respective states.

To make the situation more specific, there is no reservation for children of Chandigarh in professional colleges including P.E.C Arts College, Home Science College, Professional College, Chandigarh College of Engineering and Chandigarh Medical College. Even Panjab University and its affiliated colleges ignore any rightful place for those born in Chandigarh. Also, institutes like C.S.I.O, N.I.P.E.R etc disregard any niche to the people of Chandigarh.

Due to lack of any such convenience, the eligible youth of Chandigarh feel ignored and debilitated. Because of such repressed feelings of dejection, they are forced to move out of the city to pursue their further studies and for appropriate jobs outside their own city.

Given such a state, the Councillor, Saurabh Joshi, himself being a born-and-brought-up of Chandigarh, tends to understand the ignored status of the children and youth of the city. He feels that how ironic it is that since 1953 and with there generations of residents of the city, the rights of reservation for people of Chandigarh in various job sectors and educational institute is still overlooked. 

So, in order to quell the distress of the people of Chandigarh, the Chandigarh Administration should make adequate policies to make 85% reservation in various quarters and provide a rightful breath of relaxed air to those born in the city of Chandigarh.

Differently-abled to get 4 pc reservation in promotions in Haryana

Haryana Government has decided to grant the benefit of horizontal reservation in promotion @ 4 percent to the Persons with Benchmark Disabilities (PwBDs) covered under the Rights of Persons with Disabilities Act, 2016. A letter in this regard has been issued by Chief Secretary to all the Administrative Secretaries, Heads of Departments, Chief Administrators and Managing Directors of Boards, Corporations, Public Undertakings, Divisional Commissioners, Registrar of Punjab and Haryana High Court, Chandigarh, Deputy Commissioners and Sub-Divisional Officers (Civil) and Registrar of all Universities of the State.

Divulging more details in this regard an official spokesperson said that as per instructions, the new Act namely, Rights of Persons with Disabilities Act, 2016 has come into force from April 19, 2017, therefore, these instructions of 4 percent horizontal reservation shall be applicable with effect from April 19, 2017 onwards to the PwBDs who covered under this Act.

In case of promotion, 4 percent of the total number of vacancies in the cadre strength of Group A, B, C and D shall be reserved for PwBDs. Against the posts identified for each disability, one percent each shall be reserved for PwBDs under blindness and low vision, deaf and hard of hearing and locomotor disability including cerebral palsy, leprosy cured, dwarfism, acid attack victims and muscular dystrophy respectively and one percent combined under autism, intellectual disability, specific learning disability and mental illness, multiple disabilities from amongst persons under clauses a to d including deaf-blindness.

Horizontality of Reservation for Persons with Disabilities

The Spokesperson said that reservation for backward classes of citizens (Scheduled Castes and Backward Classes) is called vertical reservation and the reservation for categories such as PwBDs and ex-servicemen is called horizontal reservation.

The Spokesperson said that to illustrate, if in a given year there are two vacancies reserved for the PwBDs and out of two PwBDs promoted, one belongs to Scheduled Caste and the other belongs to Unreserved, the SC candidate with benchmark disability shall be adjusted against the S/caste point in the reservation roster and the Unreserved candidate with benchmark disability against the unreserved point in the relevant roster.

In case none of the vacancies falls on the point reserved for the SCs, the candidate under benchmark disability belonging to SC shall be adjusted in the future against the next available vacancy reserved for SCs.

Since the PwBDs have to be placed in the appropriate category viz. SC/BC/ Unreserved in the roster meant for reservation of SCs/BCs, the application form (in respect of Departmental examination for promotion) for the post should require the candidates applying under the quota reserved for PwBDs to indicate whether they belong to SC/BC or Unreserved category.

Competent Medical Authority to Issue Disability Certificate

The Spokesperson said that the competent medical authority to issue Disability Certificate shall be a Medical Board duly constituted by the State Government. The State Government may constitute Medical Board(s) consisting of at least three members out of which at least one shall be a specialist in the particular field for assessing locomotor, cerebral, visual and hearing disability, as the case may be.

The Spokesperson said that the Medical Board shall, after due examination, give a permanent disability certificate in cases of such permanent disabilities where there are no chances of variation in the degree of disability.

The Medical Board shall indicate the period of validity of the certificate, in cases where there are chances of variation in the degree of disability.

Exemption from Reservation

As per the notification, if any Department considers it necessary to exempt any post/cadre partly or fully from the provision of reservation for persons with disabilities, it may make a reference to the Department of Social Justice and Empowerment, Haryana giving full justification for the proposal. The grant of exemption shall be considered by a Committee set up by the Department of Social Justice and Empowerment, Haryana, constituted vide their notification dated August 3, 2011, in consultation with the State Commissioner.
